Welcome to Creative Drones :)

These Terms of Service ("Terms") govern your purchase and use of the Handlebar remote control and your access to our website at https://www.creative-drones.com/ ("Site").

The Handlebar is a remote control device designed for operating FPV drones. It is NOT a drone itself. By purchasing the Handlebar or using our Site, you agree to these Terms.

If you don't agree, please don't purchase our products or use our Site.

Understanding What You're Getting

What is the Handlebar?

The Handlebar is a specialized remote control device for first-person-view (FPV) drone flight. It's a precision electronic controller that uses gesture-based, motion-aware technology to give you control over your FPV drone.

Important Distinctions:

  • The Handlebar is a remote control device, not a drone

  • You need a separate compatible FPV drone to use the Handlebar

  • The Handlebar controls your drone; it doesn't fly itself

  • You are responsible for the drone you connect to the Handlebar

Think of simulator practice as your training ground—it's the safe way to master the Handlebar before taking to the skies with a real drone.

Your Simulator Setup: You're responsible for:

  • Ensuring your computer meets the requirements for your chosen simulator

  • Installing any necessary drivers or software

  • Configuring the Handlebar controls within your simulator settings

  • Complying with the terms of service of any simulator or game software you use

Our Responsibility for Simulator Use:

While simulator use is inherently safer than flying real drones, we still provide the Handlebar "as is" for this purpose. We're not responsible for:

  • Compatibility with all simulator software or games

  • Software bugs or crashes in third-party applications

  • Any modifications you make to use the Handlebar with specific software

  • Performance issues related to your computer hardware

Using the Handlebar as a Game Controller

The Handlebar can also function as a game controller for flight simulators and other compatible software applications.

Simulator and Gaming Use: When used with flight simulators or games:

  • The Handlebar connects to your computer via USB

  • It works with most simulator software that supports game controllers

  • This is a great way to practice and improve your skills in a safe, virtual environment

  • No drones are involved, so there's no risk of property damage or injury from crashes

Who Can Purchase and Use the Handlebar?

You must meet these requirements:

Age: You must be at least 18 years old. If you're younger, your parent or legal guardian must purchase the Handlebar for you and supervise its use.
Legal Capacity: You must have the legal right to enter into this agreement.
Drone Ownership: You should own or have authorized access to a compatible FPV drone.
Regulatory Compliance: You must comply with all drone operation laws and regulations in your location. The Handlebar is just a controller—you're still responsible for operating your drone legally.

Critical Safety Information

THE HANDLEBAR IS NOT A TOY. It's a sophisticated electronic device designed for serious FPV drone enthusiasts.

Before using the Handlebar:

  • Read all documentation we provide (user manual, quick start guide, safety guidelines)

  • Understand how to operate your specific FPV drone

  • Know the drone regulations in your area

  • Practice in a safe, open area

  • Never use it to operate drones near people, animals, or property unless you're experienced and it's legal to do so

We are not responsible for:

  • How you operate your drone using the Handlebar

  • Damage caused by drone crashes or accidents

  • Violations of drone operation laws in your jurisdiction

  • Injuries or property damage resulting from drone operation

Your Account and Purchases

Creating an Account
Some features require an account. When you create one:

  • Provide accurate information

  • Keep your password secure

  • Update your details if they change

  • Don't share your account with others

  • Tell us immediately if someone accesses your account without permission


We can suspend or close accounts that violate these Terms or sit unused for a long time.

How Orders Work

Placing an Order:

When you place an order, you're making an offer to buy. We can accept or decline that offer. We might decline if:

  • The product is out of stock

  • We spot a pricing error

  • We suspect fraud

  • You've violated these Terms before

Pricing:

  • Prices can change without notice

  • If we find a pricing error after you order, we'll contact you with options: pay the correct price or cancel for a full refund

Payment:

  • We accept credit cards and PayPal

  • Payment is due before shipping

  • You confirm you're authorized to use the payment method

  • You're responsible for any failed payments

Taxes:

You pay all applicable taxes, duties, and fees. These are separate from the product price and shipping.

Shipping Your Order

Where We Ship:

Currently shipping to: Mexico

Shipping Costs & Times:

  • Calculated at checkout

  • Delivery estimates are not guarantees

  • You're responsible for providing accurate shipping information

Risk of Loss:
 

 Once the carrier has your package, risk transfers to you. If it gets lost or damaged in transit, you'll need to file a claim with the shipping carrier.

International Orders: If you're outside Mexico, you handle:

  • All customs duties and import taxes

  • Compliance with your country's import rules

  • Any customs delays

  • We can't control customs processes or be held responsible for seizures or delays.

Returns, Warranties, and Support

Returning Your Handlebar

You can check the complete Return & Refund Policy. Here's the summary:

  • Return Window: 30 days from delivery

  • Condition: Item must be unused, in original packaging, with all accessories included

  • Return Process: Contact our support team with your order number to request a return. Once approved, you’ll receive return instructions.

  • Refund Timeline: Refunds are processed within 5–10 business days after the returned item is received and inspected

  • Restocking Fees: None

Important Legal Protections

What We're Not Liable For

Here's what we're NOT responsible for, even if we knew these problems could happen:

Damages We Don't Cover:

  • Drone crashes or damage to your drone

  • Damage to property or injuries to people caused by your drone

  • Lost profits or business opportunities

  • Lost data or footage

  • Damage to other equipment

  • Any indirect, consequential, or punitive damages

Our Maximum Liability: If something goes wrong and it's our fault, the most we'll pay is either:

The amount you paid for your Handlebar, OR 5,500 MXN
Whichever is greater.

Why These Limits Exist:

These limits are essential to offering the Handlebar at its current price. You're accepting these limits in exchange for that pricing.

Jurisdictional Exceptions:

Some places don't allow these limitations. If you're in one of those places, our liability is limited to the maximum extent your local law permits.

What's Covered Under Warranty

Your Handlebar comes with a 90-day warranty from purchase date.
We'll Repair, Replace, or Refund if: The Handlebar has manufacturing defects or material failures under normal use during the warranty period.

We Won't Cover:

  • Normal wear and tear

  • Accidents, drops, or misuse

  • Damage from modifying the Handlebar

  • Using it in ways not described in our documentation

  • Cosmetic issues that don't affect function

  • Products bought from unauthorized sellers

  • Water damage, fire damage, or other environmental damage

Making a Warranty Claim: Email support@creative-drones.com with:

  • Your proof of purchase

  • What's wrong with the Handlebar

  • Photos or video showing the issue

The Legal Part:


BEYOND THIS WARRANTY, WE PROVIDE THE HANDLEBAR "AS IS." WE DISCLAIM ALL OTHER WARRANTIES—EXPRESS OR IMPLIED—INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT THE LAW ALLOWS.

Your Responsibility to Protect Us

If someone sues us or makes a claim against us because of something you did, you agree to:
 

  • Cover our legal costs and fees

  • Pay any judgments or settlements

  • Defend us from those claims

This applies when claims arise from:

  • How you operated your drone using the Handlebar

  • Your violation of these Terms

  • Your violation of any laws or regulations

  • Damage or injury you caused to others

  • Your violation of someone else's rights

  • We can choose to handle the defense ourselves, and you'll cooperate if we do.

If you keep using the Site or the Handlebar after changes take effect, you accept the new Terms. If you don't agree with changes, stop using our products and Site.

Ending Your Account

Stop using our Site anytime
Delete your account by emailing us at support@creative-drones.com.
Stop using your Handlebar (though these Terms still apply to your purchase)

Suspend or close your account anytime
Especially if you violate these Terms
With or without warning

These Terms still apply to past purchases

Legal Framework

Which Laws Apply

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules.
This means the State of Delaware law determines how these Terms are interpreted and enforced, regardless of where you live.

Where Legal Disputes Are Resolved

Court Jurisdiction:
Any legal disputes must be brought in the courts of the state of Delaware. You agree to those courts having jurisdiction over you

Additional Legal Terms

Complete Agreement

These Terms, plus our Privacy Policy and Return & Refund Policy, are the complete agreement between us. They replace any previous agreements or understandings.

Severability

If a court says part of these Terms is invalid, the rest remains in effect. The invalid part gets modified to be valid to the minimum extent necessary.

No Waiver

If we don't enforce part of these Terms, that doesn't mean we're waiving it. We can still enforce it later. Waivers must be in writing and signed by our authorized representative.

Assignment

You can't transfer these Terms or your rights to someone else without our written permission. We can transfer them freely. Any unauthorized transfer by you is void.

Force Majeure

We're not liable for delays or failures caused by things beyond our control: natural disasters, wars, pandemics, government actions, supplier failures, shipping disruptions, etc.

Export Compliance

You agree to comply with all export and import laws. Don't export or re-export the Handlebar in violation of any applicable regulations.

Survival

Even after these Terms end, certain sections survive: those covering liability, indemnification, intellectual property, dispute resolution, and these general provisions.

Interpretation

"Including" means "including but not limited to"
Headings are for convenience only
These Terms don't create any third-party beneficiary rights
